the benefits of having a nashville hair straightener lawyer

If you used hair straightener products and suffered hair straightener side effects, contact Nashville hair straightener lawyer Timothy L. Miles
In recent years, hair straighteners have become a popular styling tool for many people looking to achieve sleek, straight hair. However, the use of these products for straightened hair have also been linked to serious health concerns. In Nashville, Tennessee, a number of individuals have filed lawsuits against hair straightener manufacturers due to allegations that their products contain dangerous chemicals that can cause serious harm.

The lawsuits allege that the manufacturers failed to adequately warn consumers about the risks associated with their products and failed to properly test them before putting them on the market. The chemicals in question include formaldehyde and other known carcinogens that can cause respiratory problems, eye irritation, and even cancer. As a result of these lawsuits, many consumers are questioning the safety of hair straighteners and are calling for greater regulation of these products.

The dangers of hair straightening products are often overlooked by many individuals who use them regularly. These products contain harsh chemicals such as formaldehyde, which is a known carcinogen and can cause respiratory problems. Prolonged exposure to these chemicals can lead to serious health issues, including cancer. In addition, the heat generated by hair straighteners can damage the hair follicles and cause breakage and split ends.

This can lead to dry, frizzy hair that is difficult to manage. Furthermore, excessive use of hair straighteners can also damage the scalp and cause irritation or even burns. It is important for individuals to be aware of the risks associated with using hair straightening products and take steps to minimize their exposure. This includes using natural alternatives or limiting the frequency of use.

Consulting with a Nashville hair straightener lawyer may also be beneficial for those who have suffered from hair straightener side effects due to these products.

The first lawsuit against a Nashville salon involving hair straightening products was filed in 2015. The plaintiff, a woman named Sarah, claimed that the salon used a product containing high levels of formaldehyde, which caused her to suffer severe burns and hair loss. The lawsuit alleged that the salon failed to inform her about the potential risks associated with the product and did not follow proper safety protocols during the treatment.

The case gained widespread attention and led to increased scrutiny of salons using hair straightening products containing formaldehyde. Formaldehyde is a known carcinogen and can cause respiratory problems, skin irritation, and other health issues if not handled properly. As a result of this lawsuit and others like it across the country, many salons have stopped using these types of products for straightened hair or have switched to safer alternatives.

The case also brought attention to the need for better regulation and oversight of salons and their use of potentially hazardous chemicals in their treatments.

If you have suffered an injury from hair straightener products, it is essential to hire a lawyer who practices in personal injury cases. A qualified Nashville hair straightener lawyer can help you navigate the legal process and ensure that you receive fair compensation for your injuries. Your Nashville hair straightener lawyer will investigate the circumstances of your injury, gather evidence, and negotiate with insurance companies on your behalf.

They will also advise you on your legal rights and options, including the possibility of pursuing a lawsuit against the manufacturer or seller of the product. It is important to choose a lawyer who has experience handling similar cases and who understands the unique complexities of hair straightener injury claims. Look for someone who is knowledgeable about product liability law and who has a track record of successful outcomes for their clients.

By hiring a skilled Nashville hair straightener lawyer, you can rest assured that your case will be handled with professionalism and expertise, giving you the best chance at receiving fair compensation for your injuries.

Over the years, there have been numerous cases of hair damage caused by using hair straighteners. In Nashville, several lawsuits have been filed against companies that manufacture and distribute these products. These cases have resulted in settlements being reached between the parties involved. One such settlement was reached between a Nashville woman and a well-known hair straightener company. The woman claimed that the product caused severe damage to her hair, including breakage and excessive shedding.

The company agreed to pay her a substantial amount of money as compensation for her damages. In another case, several women came together to file a class-action lawsuit against a different hair straightener company. They claimed that the product caused chemical burns and other types of damage to their scalps and hair. The company eventually settled the case for millions of dollars.

These settlements serve as a reminder that companies must be held accountable for any harm caused by their products.

Recently, there have been new regulations and warnings issued for hair straightening products. The FDA has warned that certain hair straighteners contain high levels of formaldehyde, which can cause health problems such as eye irritation, nosebleeds, and even cancer. As a result, the FDA now requires that all hair straightening products containing formaldehyde must carry a warning label. Additionally, some states have implemented their own regulations on the use of formaldehyde in salon products.

In Nashville, the use of formaldehyde in hair straightening treatments has become a concern for both consumers and stylists. The Tennessee Board of Cosmetology has issued guidelines for salons to follow when using these types of products. They recommend proper ventilation and the use of protective gear such as masks and gloves. It is important for individuals to educate themselves on the potential risks associated with hair straightening products and to choose safer alternatives whenever possible.

If you suffered hair straightener side effects, you may be entitled to compensation for your damages. Hair straighteners can cause serious burns, electrical shocks, and other injuries that can lead to significant medical bills, lost wages, and pain and suffering. A skilled Nashville hair straightener lawyer can help you seek justice and compensation for your injuries. They will investigate the circumstances of your accident to determine who is responsible for your damages and work to hold them accountable.

This may include the manufacturer of the hair straightener or the retailer who sold it. Your lawyer will also help you document your damages so that you can recover full compensation for your losses. This may include medical records, pay stubs, and other evidence of your financial losses. If you have suffered an injury from a hair straightener in Nashville, so not hesitate to seek legal help.

A qualified attorney can help ensure that you receive fair compensation for your injuries.

WHAT is the fda's stance on hair straightener products?

If you suffered hair straightener side effects from products for straightened hair, contact hair straightener lawyer Timothy L. Miles
The U.S. Food & Drug Administration (FDA) has the authority to regulate hair straightener products or other products for straightened hair under the Federal Food, Drug, and Cosmetic Act.  And if they are marketed on a retail basis to consumers such as hair straightener products, under the Fair Packaging and Labeling Act.

Furthermore, cosmetic products such as products for straightened hair must be safe for their intended conditions of use and must be labeled properly. Manufacturers are responsible for the safety of their hair straightener products, and they must label their products for straightened hair with all the ingredients. In a manufacturer of hair straightener products does not comply with these requirements, the FDA has the authority to take action against manufacturers of products for straightened hair that do not comply with the law.

The FDA's stance on the use of formaldehyde in hair straightener products

Hair straightening is normally applied to the hair followed by a heat treatment which seals the solution in. As the FDA explains, most hair straightener products contain formaldehyde which when heated releases gas into the air.   This presents a serious problem if a salon that uses hair straightener products is not properly ventilated because the formaldehyde can be inhaled by both salon workers and their clients.

This can present a serious health hazard as explained by the FDA: "Formaldehyde is a colorless, strong-smelling gas that presents a health hazard when breathed into the lungs, or when it gets into the eyes or onto the skin."

The FDA further notes, "According to the
National Cancer Institute, when formaldehyde is present in the air at levels exceeding 0.1 ppm, some individuals may experience adverse effects such as watery eyes; burning sensations in the eyes, nose, and throat, coughing, wheezing, nausea, and skin irritation."  And formaldehyde has been classified as a human carcinogen by the International Agency for Research on Cancer due to the fact that at high levels or exposure over time, studies have linked formaldehyde to certain types of cancers.

What the FDA says consumers should know about hair straightener products

According to the agency, repeated contact with hair straightener products that contain formaldehyde, can cause skin sensitization and allergic dermatitis can develop after repeated contact with hair straightener products. Moreover, when formaldehyde is release into the air, it can cause serious irritation to the nose, eyes and lungs.  The higher the amount of expose and the longer amount of time someone is exposed to formaldehyde, the higher the potential health risks in using hair straightener products.

The FDA list the following reactions that have been reported:
  • eye problems or irritation
  • nervous system problems (for example, headaches and dizziness)
  • espiratory tract problems (sore or scratchy throat, cough, wheezing)
  • nausea, chest pain
  • vomiting
  • rashes

THE STEPS THE FDA SUGGESTS FOR CONSUMERS CONSIDERING PURCHASING PRODUCTS FOR STRAIGTENED HAIR

If you are considering purchasing hair straightener products, here are the steps the FDA recommends.
  • Read the label. Hair straightener products are required to have a list of all the ingredients on the label. If the products for straightened hair you are consider purchasing do not list the ingredients, the FDA recommends not purchasing the product.
  • Ask a salon professional.  Ask a salon professional if they know whether the hair straightener products they use contains formaldehyde-related ingredients. If they do not know or are unsure, you may not want to use the product, particularly if you have had a reaction in the past.
  • Report bad reactions.  If you experience a bad reaction from any hair straightener products, the FDA encourages you to report your symptoms to the both FDA as well as to your health care provider.  You can report reactions to products for straightened hair to the FDA by phone to the nearest Consumer Complaint Coordinator at your nearest FDA district office, and phone numbers are posted on the FDA's Web page at Consumer Complaint Coordinators. You can also report online to the FDA's MedWatch adverse event reporting system or you can call MedWatch at 1-800-332-1088.

THE DANGEROUS CHEMICALS USED IN HAIR STRAIGHTENER PRODUCTS

Picture of young black female using hair straightener productsIf you suffered hair straightener side effects, contact Timothy L. Miles today
Chemicals used in hair straightener products include cyclosiloxanes, formaldehyde, parabens, diethanolamine, sodium hydroxide, phthalates, triclosan and benzophenone-3. These chemicals have all been linked to causing a higher risk of health problems including cancer, fibroids and endometriosis.  Most hair straightener products release formaldehyde gas, a known human carcinogen as classified by the International Agency for Research on Cancer, into the air during the hair straightener process.

Below is a
synopsis of the dangers of each of these chemicals used in hair straightener products.

Formaldehyde
According to the FDA, Formaldehyde exposure can cause both short- and long-term effects that may impact your health. The FDA also states that exposure to formaldehyde is dangerous because when it is released into the air and is present in air at levels exceeding 0.1 ppm, it can cause serious irritation of your eyes, nose, and lungs, as well as causing skin sensitivity or allergic dermatitis. The greater the exposure to products that contain formaldehyde such as hair straightener products, the greater the risk for potential health problems.

People who have experienced formaldehyde exposure have suffered the following reactions:
  • eye problems or irritation
  • nervous system problems
  • respiratory tract problems
  • nausea
  • chest pain
  • vomiting, and rashes.

Chronic effects associated with formaldehyde can include:
  • an increased prevalence of headaches,
  • asthma,
  • contact dermatitis
  • and possibly cancer.

Sodium Hydroxide
Sodium hydroxide, also referred to caustic soda or lye s a common ingredient in cleaners, soaps, detergents, and liquid drain cleaners. Sodium hydroxide is a very dangerous substance that can cause severe burns to the eyes, skin, digestive system or lungs, resulting in permanent damage or death.

Cyclosiloxanes
Cyclosiloxanes are basic members of the broad family of silicone materials.  A study by the National Institute of Health (NIH) to examine to toxicity of cyclosiloxanes found that it produced fatal liver and lung damage in mice.

Diethanolamine
Diethanolamine is corrosive and contact can irritate and burn the skin, eyes and cause possible eye damage.  It is used in specialty textiles, weed killers, detergents, shampoos, paints and metal-working fluids.  Inhaling diethanolamine can irritate the nose and throat causing coughing and wheezing. Expose to diethanolamine cause also cause headaches, nausea, and vomiting, and may affect the liver and kidneys. Diethanolamine is listed on the Special Health Hazard Substance List. Diethanolamine is also one of the primary feedstocks (substances used to produce other substances) for the production of glyphosate, a pesticide which is a component of Roundup.

Triclosan
According to the FDA, some short-term animal studies have shown that exposure to high doses of triclosan is associated with a decrease in the levels of some thyroid hormones.  An ongoing study is investigating the potential of developing skin cancer after a long-term exposure to triclosan in animals. Triclosan has also has been linked to disrupted hormonal development, a reduction in bacterial resistance and an increase in allergies.  Additionally, according to the Australian Department of Health, it can also irritate the eyes and skin.  Some hospitals have stopped using sanitizing products containing Triclosan. Triclosan is among the seven most frequently detected compounds in streams and it has even been detected in the urine and breast milk of large portions of the population.

Benzophenone-3
Wearing products that contain Benzophenone-3 has resulted in a skin allergy or photo allergy, a skin reaction that occurs with exposure to sunlight. Benzophenone-3 has also been shown to cause weak hormonal activity in laboratory animals. Furthermore, according to the NIH, “Studies show that BP-3, after topical application, can penetrate into bloodstream, blood-brain barrier and blood-placental barrier and may induce the reproductive toxicity and abnormal development of the foetus, endocrine system disruption and neurotoxicity in experimental animal models.”

Phthalates
Phthalates are detrimental to the reproductive, neurological, and developmental systems of human from multiple exposure pathways. According to the NIH, “Phthalates, as endocrine-disrupting chemicals and SVOCs, are detrimental to the reproductive, neurological, and developmental systems of human from multiple exposure pathways. Children are at a higher level of exposure and more vulnerable to phthalates.” Many phthalates are banned and restricted in multiple countries.

Parabens
Parabens are a group of chemicals widely used as artificial preservatives in cosmetic and body care products since the 1920s.  According to the Environmental Working Group (EWG), “The concern with these chemicals is that scientific studies suggest that parabens can disrupt hormones in the body and harm fertility and reproductive organs, affect birth outcomes, and increase the risk of cancer. They can also cause skin irritation. Moreover, studies have detected parabens in nearly all urine samples taken from adults in the U.S., regardless of demographic.” The EWG concluded that “Given the endocrine disruption capacity and documented female and male reproductive harm, coupled with the potential for repeated lifelong exposure, it is clear that long-chain parabens (isobutyl-, butyl-, isopropyl- and propylparaben) should not be used in personal care or cosmetic products.”

HAIR STRAIGHTENER PRODUCTS LINKED TO UTERINE CANCER AND OTHER SEVERE HAIR STRAIGHTENER SIDE EFFECTS

Young black female using hair straightener productsCall hair straightener lawyer Timothy L. Miles today about a hair straightener lawsuit
Previous studies have shown that some widely used chemicals in hair straightener products disrupt the endocrine system, which is responsible for messaging chemicals in our bodies that connect hormones to their target organs. In the past, Uterine cancer has been linked to an excess of hormones such as estrogen and progesterone, and numerous hair products can mimic these natural hormones and bind to the receptor.

Four years ago, researchers found endocrine disrupting chemicals in 18 hair straightener products they tested. More troublesome was the finding that 84% of the chemicals identified were not listed on product labels and 11 of the products were prohibited under the European Union's Cosmetics Directive or regulated by California law.  Today, U.S. regulations mandate testing for estrogen receptor activity only when it comes to pesticides and drinking water contaminants.  Hair straightener products, on the other hand, are not regulated.

A 2019 study by National Institutes of Health (NIH) found that permanent hair dye and chemicals in hair straightener products are associated with a higher risk of breast cancer, particularly among black females who use these treatments more regularly. A follow-up study in 2021 found that permanent hair dye and hair straightener products are also associated with a higher risk of ovarian cancer.

WHO HAD THE MOST PRONOUNCED CANCER RISK USING HAIR STRAIGHTENER PRODUCTS

The study data also showed that the link between hair straightening products and uterine cancer cases was most pronounced for Black females.  While they made up only 7.4% of the study participants, 59.9% of those who reported ever using products for straightened hair. Thus, the exposure among black females appears higher. Based on prior studies and literature, it is well known that hair straightener products marketed directly to Black children and women have been shown to contain multiple chemicals known to disrupt hormones and these same products for straightened hair marketed to Black females also contain a harsher chemical formulation.

Chandra Jackson, an author of the study, also stated "we know that Black women tend to use multiple products simultaneously, which could contribute to Black women on average having higher concentrations of these hormone-disrupting chemicals in their system."
