Tire Recall May be Decided in a Court Battle
ARC Automotive, Inc., a firm that manufactures airbag inflators that have been implicated in eight episodes resulting in two fatalities and seven injuries claimed that it was uncertain whether additional such incidents may arise from its defective ARC Airbag Inflators which cause Exploding ARC Airbags.
Responding to the National Highway Traffic Safety Administration (NHTSA), ARC declared that following industry quality standards cannot guarantee that there will not be incidences of air-bag inflators exploding and sending out shrapnel. The corporation contended that the federal motor vehicle safety act does not mandate that automobiles and apparatus can never have any problems in the field. However, when ARC was questioned on the matter, it stated that it had not notified any consumers that their defective ARC airbag inflators might potentially explode. Notwithstanding, ARC stated that during the 8-year inquiry into the inflators, manufacturers of airbags, car makers and the government had been warned of any ruptures that occurred on the roads that could not be accounted for. Furthermore, ARC declared that in any mass production process, it is impossible to completely eradicate the possibility of producing defects. When asked by NHTSA, ARC stated that they lacked sufficient data to calculate the number of extra ruptures that may take place on the highway. The outcome of the situation is uncertain. After concluding that the ARC airbag inflators were flawed, on May 13, 2023, the NHTSA called for an immediate recall of 67 million airbag inflators manufactured by ARC.
